1.1 The terms and conditions set out below outline the agreement between the purchaser (licence owner) and Emphase Ltd., based in Lausanne and Bern, Switzerland. By purchasing, downloading, installing, using or handling our font (digital typeface software), you accept compliance with our terms.
1.2 This agreement replaces any previously made oral or written proposal or agreement between you and Emphase Ltd. If you do not accept this Agreement, do not purchase, access, download, install or otherwise use the Diglû Font.
1.3 By purchasing this license, you become a licensed user and have the right to use the Diglû as defined in this EULA. You are not purchasing the copyright to the design or any other part of the Fonts. The copyrights belong to Emphase Ltd.
1.4 If you, the purchaser, buy for a third party, you must make sure he has read the EULA correctly and accepts the conditions, without any amendments. You cannot resell the Diglû at a different price from the one offered on www.diglu.ch.
1.5 You must not modify the Fonts (digital typeface software) under any circumstance.
1.6 Fonts can only be installed and used by the maximum number of users specified on the purchased license. Emphase Ltd. offers different licensing options depending on the number of users. Please refer to the invoice received after purchase.
1.7 Opentype font files should not be transmitted, resell, lend, rent, publish, except as provided in the terms and conditions of this EULA. They can be forwarded to a printer, and .css files to a web developer, if necessary.
1.8 The Font Software remains and shall remain, in the present and in the future, the property of Emphase Ltd.
1.9 Emphase Ltd. may revoke any license to use the font in the event that the licensee uses the font to spread hate, racism or any other discrimination. The license fee will not be refunded in this case.
2.
2.1 You are not authorized to copy the pictograms, nor any glyphs of the Diglû, to insert them in another font using a typographic creation software.
2.2 You are not authorized to modify the pictograms or any glyphs of the Diglû using typographic creation software.
2.3 Emphase Ltd. creates new pictograms regularly to insert them in the Diglû. By purchasing the Diglû, you can request to receive a free Diglû update with the latest pictograms. This update is done at the end of each year.
2.4 If you need pictograms not included in the Diglu, you can contact us on diglu@emphase.ch. These will be billed to you separately as a mandate. The new pictograms created will then appear in the future update of Diglû.
3.
3.1 You can download a trial version of the Diglû at www.diglu.ch/buy containing a sample of the glyphs and pictograms, in all styles. You are not allowed to use the trial version for any commercial purpose, self-promotion or any type of publication, either on printed or digital media. The use of the trial version is limited for testing, and pitching purpose.
4.
4.1 Diglû webfonts are included in the purchase of a license, there is no limit to the number of visitors.
4.2 The use of the Fonts on devices in your organization is restricted to preparing their use on Servers, for activities generally called “web development”. You may not upload the Fonts to publicly listed file indexes, meaning file repository systems like Github.
4.3 A copy of the Fonts may be sent to a third-party website developer if necessary. The Fonts may be embedded into websites using the CSS @font-face technique with encoded .css files we deliver. The Fonts may not be embedded into any other format or in any other way under this license.
5.
5.1 If you have technical problems, please contact us at diglu@emphase.ch. We will do our best to resolve the issue. If we are unable to do so, we will give you a full refund for your purchase, provided you submit your refund request within 30 days of your purchase. The refund effectively terminates your license to use the font.
5.2 If a license is terminated, you must remove the font from all files on the computer where it appears, as well as from Indesign packages.
5.3 Emphase Ltd. cannot be held accountable for any damage caused to a purchaser’s hardware, software or any loss of time or income that may have occurred as a result of downloading, installing or using Diglû. Diglû is downloaded, installed and used entirely at the purchaser’s own risk.
6.
Swiss law is exclusively applicable. The dispositions of the United Nations Convention on the International Sale of Goods are not applicable. The only place of jurisdiction is Bern (Switzerland).
